Your attorney will typically:

  • Request DMV hearing. 

  • Appear in Court for you.

  • Examine evidence; conduct discovery.

  • Scrutinize breathalizer machine records.

  • Investigate conditions that may have caused a false BAC reading.

  • Investigate technical defects in case. Bring a motion to suppress.

  • Seek to have charges dropped or reduced. Negotiate with DA.

  • If necessary, prepare for trial.

The above is only a partial list of typical events in a DUI case.  The proper course of action in your case will depend on the specific circumstances.

 
DUI Developments
Some Repeat DUI Offenders Eligible For Restricted Licenses Sooner

A new California law taking effect in 2010 shortens the license suspension period for some repeat DUI offenders.  The amount of time offenders must wait before becoming eligible to apply for the restricted license and the criteria for obtaining the license vary based on the type of DUI offense and the number of previous convictions.  For example, a person convicted of a second DUI offense within 10 years may now be eligible to apply for a restricted driving license after completing the first 90 days of a two-year license suspension period. Previously, a second-time offender had to wait for 12 months before applying for a restricted license.

To apply for the restricted California driver license, the offender must provide:


-Proof of enrollment or partial completion of a 18 or 30 month certified DUI program
-Proof of financial responsibility (i.e. proof of SR 22 insurance)
-Proof of Installation of an ignition interlock device
-Payment of applicable fees, including reinstatement, reissue and restriction fees
